T2 ICT to T2G cooling at 120K

Hi,

Considering a case - if someone is on T2 ICT long term and get a offer of 500 per day contract position, can s/he apply for T2G on the basis that the PBS will be more than 120k?

Tier 2 cooling off period exemptions
"The applicant is applying under Tier 2 (ICT) and the gross annual salary stated on the applicant’s current certificate of sponsorship (CoS) is £120,000 or higher (or £155,300 if their Certificate of Sponsorship (CoS) was assigned before 6 April 2017)."

Contracting is not permitted on Tier 2 General.

I have read so many posts on this forum which have ppl on T2G working as contractors or sponsor company and contracting their clients.

You can only be on PAYE with your sponsor. You can work at a clients office temporarily but you cannot be paid by the client. There is a difference!

so lets say your current client is ready to hire you and pay you on a contract position. So you find a umbrella company to sponsor you and then you work for this client.

what you are proposing, using an umbrealla company, is illegal and u wont get such advise on this forum.

Any further questions for advice such as this in order to circumvent the immigration rules and the topic will be locked and your access to the forum restricted.

What you are asking was ONLY possible on Tier 1 General and is NOT applicable to Tier 2 General.

You have asked a similar question about cooling off period in June and received the correct advice then.

Completely illegal, cannot do this.....

I am not trying to circumvent any rules. this is a genuine query as my client is ready to sponsor my general visa next year. I just want to avoid the cooling period.
