Tier 2 - Unmarried same sex partner

Post by sg871 » Tue Sep 05, 2017 8:22 pm

Hi,
I’ve tried looking around the forum to get an answer but it looks like there are many different ones and it is a bit confusing.
I am going to apply for a tier 2 visa on November through my working place. I don’t currently live in the UK and I’m not an EU citizen.
I wish my same sex partner to join me as a dependent so he will be able to work in the UK. Since we are not married and only together for about 15 months and living together for about 5 months, I’m afraid he will not receive a visa according to the 2 years cohabitation rule.
If we will get into a civil partnership or get married will it be easier to get a visa for him or will we still need to prove something? I saw some cases here that were refused even for a civil/married partner and couldn’t understand why.
Thanks

Civil Parnerrship for non EU

Post by sg871 » Sun Sep 17, 2017 6:33 pm

Hi,
Me and my partner are from a non EU country that dosen't legitimize same sex marrige or civil parnership.
If we'll conduct a civil parnership in a EU country (not UK) that allows it, will it be effective also in the UK in case we will move there?
Thanks

If it is recognised in the country where it takes place, then no issue for the UK.

Your partner still has to apply from his home country/country of legal residence though.
