Unmarried visa & dependants with / without ROA

Hi All,

I am a UK national by descent. My long term partner and I have 2 young children born outside the UK. None with British passports as yet.

We have visited the UK as a family on 2 separate occasions over a period of 2 years.

I am now back in the UK after a number of years ( family are still in the philippines )and have now worked for the 6 months neccessary to apply for a visa for my partner. I earn 30k +.

My 2 year old child has an ROA my youngest 6 months does not.

Do I apply for the ROA for my youngest together with the unmarried settlement visa for my partner?

Or do I need to process the unmarried settlement visa and add both children ( or one child without ROA) onto this visa application ?

Also for future reference if your children have ROA do you need to have a salary of 18k + to qualify for the visa or is it 25k ?

Appreciate any advice and guidance,

Update

Called the UK helpline and they are now saying that if the child is eligible for a uk passport then they will not process a right of abode.

Only issue with that is the passport takes 12 months from the Philippines. The roa is a lot quicker.

Anyone else have experience of this recently?

Nonsense. Only a British citizens (by descent or otherwise) can apply for RoA provided they do not have a UK passport.

Apologies, just re-read your first post. Your child is not British as you cannot pass on your citizenship to children born abroad as you are British by descent.

Child will need a visa in line with mother. You should also note that an absence/separation from your partner for 6 months or more will cause a problem with the unmarried partner visa and the mandatory 24 months cohabitation requirement being met.

Not sure how your 2 year old got it though and it could have been an error if child was also born abroad.

Apologies as I am not sure of the terminologies here. I am a UK national born in UK to british parents!

Seems like a catch 22 on the unmarried visa. I have to come to uk to work for 6 months to be able to bring my family over! How would I cohabit if they have to stay in the Philippines until I have worked the 6 months to be eligible to apply?

You are therefore British 'otherwise than by descent'. British by descent infers you were born abroad to British parents.

RoA/CoE for your baby.
