Switching to spousal visa before Tier 2 expires

Post by mangomm » Tue Sep 19, 2017 10:49 am

Hi everyone,

I wonder if anyone could clarify the timeline needed with regards to getting married and switching from a Tier 2 (sponsored) work visa to a spousal visa.

I have read that one cannot apply for a spousal visa if their current visa, in my case Tier 2 work, is going to expire in 6 months or fewer. Is that accurate?

I have spoken to a lawyer that says this is not the case, and one can get married and apply for a spousal visa anytime before their current visa expires.

To explain more anecdotally, my current Tier 2 work visa expires in May 2018. My partner and I plan to get married in January 2018, and apply for the spousal visa shortly thereafter. Will our application be accepted even if we are getting married less than 6 months before my Tier 2 via expires? Or, will it be rejected?

Thanks for any light you can shed!!

Rubbish. Don't believe everything you 'hear' and unless you can provide an official link, it is nonsense.
