Tier 2 ILR, threshold discrepancy on P60s due to pension

Post by scutty_33 » Sat Sep 23, 2017 4:19 pm

Dear all,
I am on tier 2 general with a reputable company and am being paid the right salary and am 11 months from my ILR application.
I have the following issues and questions, would greatly appreciate if my doubts and fears could be dispelled.
I'm, on 33k, didn't take any unpaid leaves for more than a year, am being paid right amount in my bank and payslip, but have 1% deduction on my payslip which goes into pension which should be 330 or so per annum, my april 2017 P60 shows around 800 pounds minus, it shows earned 32200.00,
Question 1: is this going to be a problem during my application?
my April 2016 P60 shows about £1500 less!?
Company said I should check with a solicitor and are not interested in replying to me.
Im all worried and stressed what would this lead to?
Kindly advise if this could pose a problem with UKBA? as salary in bank and on payslip is right but why such a huge deficit on P60s?
Have pensions messed it up?

Regards
Scutty

The salary threshold for ILR is £35,000pa not £33,000pa so based on what you have posted, you are still short.

BTW, HO base it on your salary BEFORE any deductions.

Thanks for your reply CR001,

I will get a wage increase hopefully in January.

So my pension deduction and 1500 minus and 800 minus showing on 2 x p60s should not be an issue?

When do you plan to apply for ILR?

Be wary of a abnormally high salary increase just before applying for ILR. It is a red flag to HO and will likely be investigated.

i believe a 2 grand increase isn't too high, i have regularly gotten salary increases, every year by 3 or 2 grand, but thanks

If you are the only one getting a £2k-£3k increase in the company, it will be viewed as suspicious.

In fact the PO will need £35500 by the time he's/ she's applying for ILR in 11 month's time. And it will depend on his/her SOC code and the contract hours to calculate if he/she needs more or could get away with less.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
