Retain rights of residence and student loans

Hi,
I, a non eu national retain my rights of residence after 4 years of marriage to an Eu national. My question is do I qualify for student loan if I want to start uni in Jan next year? Thanx

My understanding is that you need 3 years residence AND settled status (PR).

Thanx for the reply....so from your understanding I don't qualify because I don't have permanent residence status? If that's the case why am I still being classed a family member of EU national.

Because you're now divorced the loan will not be granted and is without right of appeal against.

That's where they stand as far as I've experience.
The family member on your RC is just a fomality because you've Retained your right on your own merit but they chose not to change it to be ex.
It is really good to help and everyone deserve to be respected in life. Good luck.

Yes and it's because you have to declare that you are now divorce.Even if you are still together they will request for the EU ID/Passport and marriage cert as a married person but you are not now.

The requirement for ILR/PR was rejected by the Supreme Court in Tigere.

The current requirements are listed below.
Page 19 of the Government Response to Consultation following the Tigere Case wrote: Interim Policy published following the Supreme Court ruling in the case of Ms Tigere
The Department will consider these individual cases against the following criteria:
• those under 18 years of age to have lived in the UK for at least 7 years;
• those aged 18-25 years spent at least half their life in the UK;
• is ordinarily resident in England; and
• has been ordinarily resident in the United Kingdom and Islands throughout the three year period preceding the first day of the first academic year of the course.
