Wich options do we have / visas? Help please.

Hello,

I am a romanian computer engineer working in the UK for about 3 months now. I have an american girlfriend who is now in the states but was in Europe where we lived toghter in my home in Romania and also spend some time in London after. We are togheter for about 1 year now with lots of proofs. She is looking to come to UK and be able to work here and we would like to marry as we do love each other and care for each other. My question is what choices do we have so we can both live and work in UK as I am still new here and I have a full time job? We basically want to live togheter and get married and settle in UK. Easier to bring her if you are married.

To qualify for an unmarried partner EEA residence card, you require rock solid evidence of 2 years 'living in a relationship akin to marriage'.

If you are unmarried, it may be difficult. You will need to prove that you have been in "a relationship akin to marriage" for at least two years. A relationship akin to marriage means joint bank accounts, joint mortgages, joint bills, etc, ideally addressed to the two of you living together in the same location. A boyfriend/girlfriend relationship will not cut it.

On the other hand, if you are married, her rights to reside and work in the UK flow from your marriage to you, an EEA citizen in the UK exercising treaty rights. That would be a much more straightforward application.

So work out, between the two of you, how both of you want to approach this (as this impacts much more than a visa).

Truth is we want to be togheter and we want to marry too and we are planning on marrying this year in december when she will be coming over. The question now is if we marry in december do we have to marry in my country, Romania, or can we marry in UK. It is not a big difference but due to work commitment I might have to stay in UK. After we get married what would be the next step to do so me and her can stay in uk and she also can work, as she is really a hard working american.

If we are married in december is she allowed to stay with me in UK and apply for jobs ? She got alraedy some interviews for good jobs but they dont provide sponsorships for a work visa.

We both are hard working people and is pure love that makes us go this way and we really put a lot of effort into beeing togheter.

It's not permitted to marry while in the UK as a visitor.
