Wife - Requirements for entry clearance or leave to remain

Post by johnddd » Mon Sep 25, 2017 9:22 pm

Hello

I have the following question. I met my girlfriend here in the UK. She was a student when we started a relationship. I work under Tier 2 before I met her. She left UK before her student visa expired. She came back to UK with a tourist-visitor visa to visit me. We will get married next year in our country, so she can join me here in UK as a dependant.

Checking the family member requirements, the section 319C -h mentions that "An applicant who is applying for leave to remain must not have last been granted entry clearance or leave as a visitor".

My question is: My gf last entry was a tourist. Is that tourist-visitor visa going to cause the spouse/wife dependant visa rejection? I just don't get this requirement.

Any help understanding that requirement would be appreciated, I understand all of the regulations in that section, but this numeral make no sense to me.

Regards

You are misunderstanding. It means she cannot switch to leave to remain as your partner if she is IN the UK as a visitor.
