My lawyer told me that as per the latest changes in the law, the child has to complete 5 years of the qualifying period before she becomes eligible for ILR so could not add her in the application. A friend had a similar situation and he called up UKBA. They confirmed that the child has to complete 5 years in the UK.
319J. Requirements for indefinite leave to remain
To qualify for indefinite leave to remain under this route, an applicant must meet the requirements listed below. If the applicant meets these requirements, indefinite leave to remain will be granted. If the applicant does not meet these requirements, the application will be refused.
Requirements:
(a) The applicant must not fall for refusal under the general grounds for refusal, and must not be an illegal entrant.
(b) The applicant must be the child of a parent who has, or is at the same time being granted, indefinite leave to remain as:
(i) a Relevant Points Based System Migrant, or
(ii) the partner of a Relevant Points Based System Migrant.

Not being patronizing (i cant be , if u see my flag), but if you go to cheap, small run down offices which claim to be immigration lawyers, this is the kind of wrong advise u get.
Their advice is still woefully wrong, regardless of how much was 'paid' and how 'good' they supposedly are.
