Family Visa to Latvia

Family Visa to Latvia

Hello, We want to apply for Family visa to Latvia for my husband who has Nigerian and British citizenship. The reason for this is so he could freely travel to visit my family not because he has British passport but because he is a family member of Latvian national. We have had issues with Latvian Embassy as they have previously given us wrong advice about traveling to Latvia, and not accepting my application form to legalize our marriage in Latvia.
Has anyone had some experience in Visa questions and application procedure in Latvian Embassy London? Also, is there a chance of appeal if the application is declined?

As a British passport holder, he is free to travel in and out of any EU country, including Latvia without requiring a visa.

Hello,
Thank you for your response.

The reason for this Latvia visa application is to get the Latvian Government actually to recognize my husband as a member of my family and possibly take them to court if they fail to do so. We have been married for 6 years and Latvia still does not recognize our marriage though we have acted on everything they requested from us. Now I am in the situation where I can change my surname in British passport but not in Latvian passport, and as far as I understand I can not legally have 2 passports with 2 different names. And, if I travel to Latvia with my kid I have to carry their birth certificate with me as our surnames are different - our kid has husband's surname. This is why I asked if there will be entitlement for appeal as in that case we can take this to court and if the court rules that my husband is a family member then they (Latvia) have no reason to decline the marriage legalization.

It would be a offence against eu directive 2004/38 to give a eu citizen a latvian visa.
It is maybe possible to apply for a residence card due to national immigration law in Latvia if he don't want to exercise his treaty rights for a stay longer 3 month.

Could you please advise how I can actually legalize my marriage if I feel that they (Latvian Embassy London) are not willing to legalize it only because my husband is Nigerian and we got married in Nigeria.First of all they asked me to provide them with Apostille issued by Nigerian High Commission to approve the authenticity of the marriage certificate, I had to explain that Nigeria can not issue it as they have not signed Hague Treaty and not on the list of countries that can issue Apostille. (actually first thing they said to me was - we already have 3 marriage certificates like yours here). They asked me to get the marriage certificate authenticated in Nigeria High Commission London, I done that, went back to Latvian Embassy London and they took copies of our passports and marriage certificate and told me that they do not have a signature sample from the person who signed the authentication in Nigeria High Commission so they can not legalize it. They said they will ask to provide the sample, now 6 years later after chasing them several times they still have not done it. Latvia say they have requested NHCL to provide signature example on several occasions, when we ask for dates - they cant provide them. NHCL say they have not received any requests.
In Latvia I was advised that if I had legalized the marriage in the UK then Latvia should automatically accept it was valid. but the thing is - I don't need to legalize it in The UK as it is already recognized and legal.
So can I legalize something that is legal in one country but not legal in another EU country?
As far as I understand we can not re-marry in the UK as our marriage is already legal in the UK
We can not re-marry in Latvia as they will ask for a document stating that my husband is not married in Nigeria, but guess what - he is married to ME.

I think it is more a question for a latvian lawyer about national law in Latvia.

Another possibility.
The latvian embassy in the UK is acting under the authority of the latvian ministry of foreign affairs.
You can try to file a complaint via the online contact form.
