Question About Extending Stay When Applying Under FLR(M)

Hello,

I had encountered in the guidance notes for FLR(M) (Section 14 to be precise) that so long as you apply before your visa expires, that your current status continues until a decision is made. My question is two-fold:

1. If they deny the request, would appeals also extend the status? And
2. Would I receive something stating this after I apply? The big issue I have is with my employer. They will not want me working for them if I do not have a legal right to, and I would require some level of proof to provide them.

What do you mean 'deny the request'? There are very limited appeal rights, but in general yes, appeal rights extension the Section 3C protection.

No you don't 'receive anything'. An employer can do an employee right to work check online. Google 'Section 3C of the Immigration Rules/Act'.

Apply in person for a same day decision if you are that concerned by it (if you can afford the extra fee to apply in person).

Thanks for the answers, I didn't realise there was a place online they could check. I was planning to apply same day because I was worried about this scenario, the problem is the fee and this was me thinking I might be able to avoid it.

Discussions to be had with my employer it appears. And regarding "deny the request" I was referring to if the ECO very clearly made an error. I am quite confident I qualify, but I'm worried based on some of the stories I have read on here that I might get a bad ECO who screws up. Just want to make sure that isn't going to send me back home when I really couldn't afford it. This application is literally costing all of my savings.

ECO = Entry Clearance Officer - for applications made OUTSIDE the UK.

Applications inside the UK are assess and processed by Caseworkers.

Interesting, didn't realise they were managed by different people. Either way that is the only thing I'm really worried about, someone on their end making a mistake (there are a lot of horror stories on this board and I've read that only 10% of applications are approved). I really appreciate the quick replies.

This is nonsense. Don't believe everything you read. If you meet the requirements and have no severely adverse immigration history/issues, there is no reason to be refused.
