Advise needed please

Post by fatimahh » Mon Oct 02, 2017 2:14 pm

My niece, brother daughter, has been leaving with her mum since we lost sight of her dad. We don't know is whereabout :( . Unfortunately the mum has now passed away. I would therefore like her to join me in the UK.
Do you think that is possible? if yes which application do i need to fill?
Please note that she is 18 and i am a PR holder, i work fulltime.

Your advise will be greatly appreciated.
GOD BLESS!!!

If she is already 18, then no there is no route though you as she is considered an adult.

She will have to apply for a visa that she qualifies for (student visa perhaps or Tier 5 depending on her nationality).

Tier 5 YMS won't apply as she is not from a qualifying country.

https://www.gov.uk/tier-5-youth-mobility/eligibility

Tier 4 student, she needs admission to a university/college and a CAS before she can apply. She will pay international student fees and these are payable upfront. She will also have to have substantial funds to maintain herself for at least 9 months.

This is a challenge then - having to pay full student fees upfront.... thank you for your help

And of course she has just missed the intake for September.

Also, make sure if you are going to go the student visa route that it is an HO approved university/college.

Also, there is a limit of 5 years I believe that she can study. She also cannot apply for ILR/PR from a student visa.

This is harsh :( i knew it would not be straight forward bringing her down here, but this is really hard. She is 18 but will now be dependant on me. i just wanted to keep a close look to avoid any problem.

No route unfortunately based on your status and as you are not an EU citizen but a RoR PR non-EU citizen, you cannot even use the EEA/EU route, which might have been possible had you been married to your EU ex spouse.

Nope. It would be the same as now with you only holding PR.

An 18 year old is not considered a 'dependent'.
