Spouse Visa- Intend to Live Together

Hello everyone,
I am a Turkish citizen and my husband is British. I live in the UK and my Turkish Nationality Visa got refused from Home Office. I am in a process of submitting a FLR (M) application to the Home Office but we have a problem. I stay with my husband but I am not on the rental contract and I can not be. I also have an art studio which I am resident of. We intend to live together legally in the future but I do not make enough money at the moment. Hopefully after I get my spouse visa , I will find a job and make enough money for us to live together. Do you think this is a problem for Home Office?. We meet all the requirements except living together at the moment. We want to live together legally but we need to save some money for our house. Please help and advise what we can do.

Your post isn't clear. Do you have income of at least £18,600 p.a? This can be joint earnings.

The mandatory requirements are for you to be living together, with the documented evidence to support this.

Without meeting the minimum income level and proof of co-habitation, your FLR(M) application will fail.

In addition to this, do you have a valid visa to reside in the UK? If not, you are unable to submit a FLR(M) application from within the UK and will have to return to your home country to apply for a Spouse Settlement visa from there.

Which category of visa did you apply for previously which was refused?

Hello, yes my husband makes 43,000 gbp for a year but as you know housing in London is so expensive and we want to live together legally after I get my visa. I stay with him at the moment but we can put my name on rental contract. We intend to live together.

My visa category was ECAA, for Turkish Nations. I had a year and it expired then I applied for an extention, it got refused , they gave me 14 days to Administrative Review or change my visa type. I am gay and the current government in Turkey has anti-gay approach ( both in law and society) , so I will be applying for the spouse visa in the UK

Without a valid visa you will be unable to submit a FLR(M) application from within the UK. :!:

When did you marry or register a civil partnership?

I got married in July 2017 in London. The refusal letter home office sent says I can change my visa type. I do not have a valid visa but there is no deporting decision. I also talked to some lawyers , because of Turkey's situation, lawyers say there is a chance to submit it in the UK

First FLR(M) Application

Hi all,
Firstly, thank you so much to all involved in this forum - it really has been a huge help.
My husband(British citizen) and I ( Turkish citizen) are applying for our first FLR M spouse visa. I wondered if anyone could help with our concerns.
We got married this July 2017 in the UK, while i was in the UK on a ECAA (Turkish business person) visa.
Because of various issues with rental contracts etc, we don't officially live together at this time, although we intend to move in together as soon as possible. I have read differing reports on whether this will affect our application - some saying we must prove we live together, or prove we intend to live together.
Does anyone have any insight on this issue? It would be greatly appreciated.

My previous comments remain unchanged.
1. You are unable to submit a FLR(M) application from within the UK without a valid visa.

2. Unless you have documented evidence of co-habitation, any application based on your spouse will fail.
