Applying for a Tier 4 dependent visa after Tier 2 ICT visa is curtailed

Post by NRP » Wed Oct 04, 2017 12:26 am

Hi,
My employment with the current sponsor ended on the 30th of September 2017, and they will notify the HO within the stipulated 10 days. I have read and understood that I will receive a letter of curtailment in due course, but have at least 60 days to explore options/actions.
My wife is in the process of applying for a Tier 4 General visa for a course that is >12 months and NQF Level 7. She will apply from the home country, as she is currently holding an ICT dependent visa. My question is, can I, being the Tier 2 ICT main applicant apply for the Tier 4 dependent visa, from UK, without going back to my home country and applying from there, now that I'm technically unemployed?
Thanks!

Yes u should be able to.
As far as i understand, only university students are allowed to bring their dependents.
Is her course at a uni or a college?

Thank you. She has enrolled and already commenced a Master of Arts course at a college (listed as a trusted sponsor), which is 15 months in duration. The degree awarded is from a University.
Any information or rules cited to confirm that I can apply for a Tier 4 dependent visa, whilst in the UK, is much appreciated.

Yes, I have read this. Let me repeat my question. I was actively employed by the sponsor under Tier 2 ICT till the 30th of September. Considering that I am no longer employed and in-between curtailment, can I still apply for a Tier 4 dependent whilst in the UK, prior to the date stated in the curtailment letter (when I eventually receive it)? The ICT visa is valid till 2021 - my employment was terminated prematurely.

Curtailment letters can take many months to be sent out. You are only in the curtailment period of 60 days when you get the letter.
