Does working for employer prior grant of Tier 2 Visa affect ILR applications?

Post by James King » Fri Oct 06, 2017 12:58 pm

Hi All,

Unknowingly, i.e. the rule immigration rule in place, I started working for my employer B while I was switching from employer A.

I left employer A in February (18th Feb 2015) and Joined employer B in end of March (30th March 2015).
I applied for my Tier 2 Gen. visa in April. But got refused in July due job not adverised at JobCentre.
I reapplied in August and my application got granted in September 2015

Now it's almost time to apply for ILR. Will it affect my application in any way, please?

Thank you.

You worked for an employer who was NOT your Tier 2 General sponsor and this is a breach of the Tier 2 General visa conditions.

Even if the fact that you worked with Employer B is ignored, the more than 60 days gap between end of employment with Employer A (Feb) and application date (Aug) will result in rejection.
