30 hours childcare , one parent ILR

I am on ILR and both my wife and son are on Tier 2 dependant visa. I am struggling to find answer to my question from a reliable source, regarding eligibility for the 30 hours free childcare whilst living in England. I 'think' that I am eligible to apply as I do have recourse to public funds..but a bit unsure since my wife does not have any recourse to public funds. Can someone kindly direct me to a relevant source that makes this point clear (just to be sure so that we don't have any issues when we apply for ILR for my son and wife in future).

Anyone subject to immigration control cannot claim it. A person on ILR can claim it.

Do both parents work?

A parent who has leave to remain with the NRPF( No recourse to public funds) condition cannot apply for this additional childcare. However if they have a partner who is entitled to apply who does have recourse to public funds then they may make the application instead

So can we apply for 30 hours childcare if i and my daughter have British passport?

My wife is on FLRM visa.

i try to check UKBA,HMRC and council webiste but i cant find this exact information.

when can we see this info on gov website?

i read all post but still not clear that because of my wife can we apply or not?

the link attached is for 2 years childcare? Doesnt have info for 30 hours new scheme....

You clearly did not click on the NRPF link within the link I posted :idea: :idea:

A person on ILR can claim as can a person who is British. Your spouse on FLR(M) cannot claim.

Hi,

I have a question relating to this. I have gotten my ILR and my wife and daughter are in tier 2 dependent visas. They are going to apply for ILR next month. I would like to apply for 30 hours funding now as the deadline is 30th December.

Will me getting 30 hours funding have a negative affect on my wife's ILR application? In the visa website, it says dependents applying for ILR though Tier 2:

When you apply for settlement, you and your partner must:

- be living together in your own accommodation
- not be using public funds

None of your posts in the past state when your dependents visas were issued which would determine when they qualify for ILR.

Hi,

My wife arrived in the UK under tier 2 dependent visa on 25th September 2015. I have received my ILR recently and my wife is eligible to apply for the ILR as she has completed the required 5 years. If I apply for the 30 hour childcare, would her ILR application be rejected? In the UKVA website, it says 'You and your partner should not receive public funds'

As stated previously, how does your wife qualify for ILR if she only came to the UK in 2015???

I would suggest your wife gets ILR first before you claim anything to avoid any risks. She could have applied ages ago already.

CR001 Do you advise the same for those applying for ILR 10 year long residence? I’ve recently applied in my name as I have ILR and received approval but I’m hesitant to use it next term as we’re worried it may affect my husbands application for SET(LR) due to apply in 4 months time. Many thanks.

There is information in the NRPF website and the UKVI website.

The NRPF website says:
" A parent who has leave to remain with the NRPF condition will not be eligible for this additional childcare. However if they have a partner who is entitled to apply and who has recourse to public funds then they may make the application instead. "

In the UKVI website, I see (for partners of a person settled in the UK):
When you apply for settlement, you and your partner must:
* be living together in your own accommodation
* not be using public funds

This would actually mean, yes you can apply for 30 hour free child care if one parent has ILR but if the partner has ILR, he/she would not be eligible. What? NRPF is missing information and really important information.

Further into the dependant ILR application, there's a question:
"Do you or anyone else who is part of this application receive any public funds? (Required) "

I don't know what that means. Does this only include persons who are applying for ILR as part of the current application? Or does this also include a partner who has already received ILR?

It further says:
" Include details for your partner or child if you have one. Examples of public funds include Income Support, Child Benefit, Housing Benefit, Council Tax Benefit, Carer’s Allowance and Disability Living Allowance. See a full list."

Hi

Just following up with this. I will get ILR next month but wife will continue to be in PBS dependent for next 3 years (as she will qualify only after that). So when I apply for child Benifits or 30 hours in nursery, would my wife be having any issues when applying ILR after 3 years? (As one of the questions in ILR application says ‘does your or your partner claim any benefits’)
