ILR Dilemma

Post by sam0101 » Sun Oct 08, 2017 6:51 pm

Hi all,

Could anyone suggest me what application I can go for, My immigration history is as follows.

My husband is currently on ILR issued on basis of Long residence ( SET LR 10 years ), granted on 16/09/2017

My status
Tier-1 dependent granted on 21/06/2011 - entered uk on 02/10/2011

Tier- 1 dependent 21/06/2011 to 26/02/2016

Applied for ILR on 25/02/2016 - as Tier -1 PBS(5 years) dependant along with my husband. Application rejected on 30th April 2017 as my husbands application was refused. Admin review was also rejected in June.

Applied for Tier 2 dependent in June which was granted on 06/07/2017. All the applications were made in time with in 14 days (3C) of the rejections from Home office, so never an overstayer.

My Husband applied for ILR based on long residence( 10years) on 09/09/2017 for same day service and was granted ILR.

To sum up
Entered UK on 02/10/2011
Tier- 1 dependent 21/06/2011 to 26/02/2016
Tier-2 dependent 06/07/2017 to 14/06/2018
( the gap 26/02/2016 to 06/07/2017 between above two visas is legal stay as my applications were under consideration by Home office)

Now as my husband was granted ILR(LR) can I also apply for ILR?.

If NO

What application should I go with and How long should I stay as a dependent before I can apply for ILR.

Any help is much appreciated and Thanks in advance

No you cannot apply for ILR.
What application should I go with and How long should I stay as a dependent before I can apply for ILR.
You should switch to FLR(M) which will be a new 5 year route to ILR (2 x 2.5 year visas) or based on 10 years long residence in 2021 if you reach that first.
