Hi Friends,
I entered UK in Nov 2011 in long term ICT T2. My VISA expired on Nov 2016 but I applied for ILR before that so I was lawfully allowed to stay till the decision which was in May 2017.

My question is when my cooling period overs. The rules says which ever is sooner. What does that means. My VISA expired on Nov 2016 and I left UK on May 2017, so Nov 2016 is sooner, so will the 12 months duration be calculated from that ?

a Tier 2 (Intra-Company Transfer) applicant in the Long Term Staff sub-category will be
granted leave up to 5 years. You will not be able to extend your stay beyond 5 years
(or 9 years for any staff earning £120,000 or more) and you will not be able to re-apply
to return to the UK under an Intra-Company Transfer category until 12 months after
your last leave as an Intra-Company Transfer expired or 12 months after you left the
UK, whichever is sooner.

Why did you apply for ILR?

Your cooling off period starts from the date you LEFT the UK, so May 2017.
