Tier4-Tier2 complicated story, help plz.

Post by Icesoft » Fri Oct 13, 2017 9:36 am

Dear All.

Got a very complicated case here, Could anyone kindly help me please.

I was a student here under tier 4 visa and got a job under tier 2 with my previous employer after I got my masters degree in the UK, but during my visa application our business got acquired by another firm and the new employer decide to keep me on-board and my visa application along with my previous employers visa sponsorship got TUPE(Transfer of Undertakings) to the new business.

But sadly the new employer's sponsorship licence application got refused due to missing documents. My students visa is already expired due to the long waits... and I'm not sure what to do.

Could anyone let me know the following questions, please.

1. Did I still considered under tier 4? as I haven't got a tier 2 visa yet.

2. Could I still looking for jobs in Britain?

3. When Should I leave Britain If I could not find a job? I have checked the UK Gov website but could not find relevant info as my tier 4 visa is already expired and I haven't got a tier 2 visa yet.(And all my documents are still with the UKVI)

4.My employer is trying to appeal for the sponsorship licence, Is there any chances? Have anyone got any similar experience that you could kindly share?

I would appreciate any help from anyone who could contribute to my questions!

Thanks very much and have a lovely day.

Best Regards

Bella

If you have not received the curtailment letter, then u are fine for now. U can look for other jobs too.
If the sponsor application is rejected, they are better off applying again and sending the right documentation rather than appealing.
