RLMT confusion on"Last granted Permission"

Hello. Some confusion about this RLMT.

If the student Visa expires in January. and the COS and License of the employer would likely be granted in February. Could the visa application waive the RLMT? As it was written as exempted were they have, or WAS LAST GRANTED under Tier 4.

Under such scenario. should it be applied as a switch, or should it be applied as a totally new Visa application as the Tier 4 visa has expired.

"You do not have to carry out a RLMT if a migrant you want to sponsor is applying for Tier 2 (General) leave in the UK and has, or was last granted leave to enter, or to stay in the UK under one of the following:
Tier 1 (Post-study work)
Tier 1 (Graduate Entrepreneur)
The International Graduates Scheme
The Fresh Talent Working in Scotland Scheme
The Science and Engineering Graduates Scheme. or where
They have, or were last granted permission to stay in the UK as a Tier 4 migrant or as a student and during their last grant of leave, or a continuous period of leave that includes their last grant of leave, they have received final results confirming they:
have passed and will be (or have been) awarded a UK recognised bachelor' or master's degree, or
have passed and will be (or have been) awarded a UK Postgraduate Certificate in Education, or
have passed and will be (or have been) awarded a Professional Graduate Diploma of Education, or
have finished a minimum of 12 months study in the UK towards a UK PhD."
