ILR- English Language Requirement & MN1

Dear all, Gurus, Moderators & everyone else,

First for all I would like to thank you all for such a website where you can get answers to any questions you have. I am following this website since 2011 and it has helped me every time I needed it. Hats off to all of you who are continuously involved in whatever ways you can to help any member of public with such a brillant website.

I was wondering if you can help with my case below.

Me and my wife are eligible to apply for ILR sometime next month. I am on Tier 2 General, about to complete 5 years next month and my wife is my dependent and again she will also complete 5 years same as me.

Our daughter was born in the UK September last year. She went to India for 2 months in March and was back to the UK in May. We had to take her Indian passport and dependent visa from the UK before she left for India so that she can return to the UK without any issue.

We are planning to give Life in the UK test sometime soon. My wife gave academic Ielts in 2009 and scored overall band score of 6.5. I am not sure if she used that for her entry clearance or not. Her entry clearance was on Tier 1 PSW dependent. My question is can she use that Ielts certificate to prove her English language requirement for ILR or she will have to take a new one?

Second question is, can my daughter apply for British citizen using MN1 form once we have been granted ILR? If yes, will her dependent visa remain valid from the time we have ILR to the time she becomes British citizen or her visa will be invalid as the main applicant had switched from Tier 2 General to ILR?

She will likely need to do a new English B1 test from an HO approved provider.

You can skip ILR and yes her dependent visa will remain valid. Please ask citizenship MN1 questions in the 'British Citizenship' sub forum as not relevant to the 'ILR' sub forum.
