Staying in UK during RLMT process

Hi all,

I need a quick help. At the moment I am working in a UK company with my dependent visa. I am dependent of my wife and her visa type is ECAA (Ankara Agreement).

I am thinking to switch my visa type to Tier 2 General, my company has sponsorship licence.

I read lots of topic in form and as I understand if my company accepts to sponsor me I have to go to my country back and apply Tier 2 from there.

But there is one thing I could not find in the forum. Before they provide me CoS they need to perform a RLMT and I do not know if I can continue to work in my company during this RLMT process.

- Do I need to go back to my country during RLMT process or can I continue to work in my company?

- if I can continue to work, does it mean I should go back to my company when RLMT finish and CoS given to me?

No need to leave the country during RLMT.

RLMT has to prove to HO that you are not 'pre-selected' (difficult when you already work for them) and that no other setttled, British or EU citizen is suitable/available for the job.

You can only get a CoS after RLMT if you are selected as the successful candidate. Your employer also should not make the RLMT so restrictive and tailor it to you that it excludes everyone else.
