What visa for dependent newly entered UK

Post by kannaiah » Mon Jun 29, 2015 12:33 pm

Hi,

I moved to UK on Tier 2 General in June, 2010.
And I'm planning to apply for ILR.
My question is about my spouse, we got married in Dec, 2014 and she got her dependent visa in Feb, 2015 and she entered UK in May, 2015.

If I apply for ILR, how should I proceed with my wife's visa?
Do need to get her visa updated?
Does she also get ILR?

Regards,

ILR for spouse, which route to chose

Post by kannaiah » Sun Oct 22, 2017 4:23 pm

Hi,

I received ILR more than a year ago and I'm receiving my British Citizenship in December 2017.
My wife in in UK since May, 2015 on dependent visa.

I would like to apply citizenship eventually.

As rules have changed quiet a lot I'm not sure what category we should go ahead?

Please guide me.

Thank you.

If she is on Tier 2 Dependent visa since 2015, she doesn't qualify for ILR yet. She needs 5 years residence counted from the date she entered the UK as PBS Dependent.

She will need to apply for a Tier 2 Dependent extension, which will be granted for another 3 years.

It appears from your other posts that your wife holds a PBS Dependent visa. As you obtained ILR through the 5 year route to settlement (and not under long residence), your wife can continue to extend her visa under the same category until she has completed 5 years in the UK.
