Spouse Visa - Financial Requirment Enquiry

Post by mhy01 » Sun Oct 22, 2017 9:19 pm

Hi any help much appretiated. I am hoping to apply for my a spouse visa but I am still pondering about a few minor queries. The basic issue is around the reading of the financial requirement and its application to my circumstance. I am failing to understand whether I fulfil the the financial requirement or not, and its implication of my wife's application.

I earn more than the £18,600, but via two jobs. One is contracted with the NHS and pays £17000. The second is contracted with NHSP (provider of staff in the NHS to cover shifts throughout the year). The second job makes up for the shortfall (£1600) quite easily, BUT the contract is devoid of any gurantee of hours or money. I only work my second job on the weekends, but there is no contract to suggest that I am guranteed ANY hours and thus any pay at all. The contract with the NHSP simply allow me to book shifts whenever I want, rather than actually specifying a set number of hours worked. So even though I earn more than the £18600 requiremnt in order to apply for the spouse visa, I am scared to do so because I cannot show the two contract specifying guranteed hours/pay totalling more tahn £18600.

Am I reading too much into this or should I be genuinley concerned?

Do I have to show 2 contracts guranteeing hour/pay totalling at least £18600, or am I able to still able to apply with 1 NHS contract guranteeing £17000 and make up the additional £1600 by working a second contracted job, albeit one which doesn't gurantee income or hours but simply allows a person to work as much as one can?

Thank you in advance for any response.

Do you have any documentation regarding your second job, i.e. letter?

If i am not wrong then you have two jobs..one salary employment(fixed hours or pay) and second job is zero hour contract( non salaried employment where salary vary depend on number of hours and where you get hourly rate)

You can combine boht salaried and non salaried employment if you are in boht jobs for at least 6 months prior to date of application

calculation for salaried and non salaried under CAT A is bit different

A) Salaried employment = ( take lowest earning from last 6 month and multiply with 12)

B) Non salaried( zero hour contract/hourly rate/ pay vary each month depend on number of hours ) = Addup last 6 month earning and divide by 6 and multiply by 12

To know you meet the requirement = combine A+ B

You are ok if total is £18600 or above

Financial requirement for spouse visa

Post by mhy01 » Thu Nov 09, 2017 6:31 pm

Hi I have a query regarding the spouse visa applications specifically the financial aspect of the act.

Currently I have just started a new job in the NHS, and I earn £16890. I also have a secondary job which will allow me to earn up to £5000 / £6000 a year. This is more than the requirement of £18,600, but the issue is that with the latter there is no contract which can affirm the amount I can earn, nor guarantee me any hours (essentially a zero hours contract with the nhs). It’s basically working as a bank worker (cover worker). I earn minimum £102 and maximum £170 on Sundays and if I work Saturdays, minimum £78 and maximum £130.

So working on weekends would earn me an additional £180 minimum easily a week but the issue is that although I have a contract saying that I work as a bank/cover for the NHS, there is no specification of how many hours I am guaranteed to be able to work.

Therefore would you hat hinge my spouse application in any way?

I can provide evidence of my first job with a guarantee of £16980, but I can’t prove that I will earn the additional amount from my secondary job even though I will earn at least twice that amount during the year.

What are your thoughts?
