Tier 2 General - Settlement Route Requirement

Hi,

I am currently on a tier 2 general visa with restricted CoS. Recently I have applied for dependent visas and the UKVI letters mention, currently the visas are granted under 10 years settlement route, with option to switch to 5 years route. Note that earlier there was no mention of settlement route in my UKVI letter.

1. How to check which settlement route I am in?
2. What are the eligibility criteria for 5 year route (both for main applicant and dependents)?
3. What kind of application is required to switch from one route to another?

What application form have you completed for your dependents?

Where are your dependents applying from?

How long have you been in the UK on tier 2 general?

1. Application Forms: Tier 2 General Partner - Upto 3 years and General Child - Upto 3 years (Applied online)
2. Dependents are applying from India.
3. I am in UK for last 6 months on tier 2 general visa.
4. Exact wording in UKVI letter,

(Non-Standard 2) - because you satisfy the requirements of paragraph GEN 3.2 of Appendix FM

it means that you are currently on a 10 year route to settlement. If you continue to meet the requirements and make the appropriate applications for further leave to remain, you are likely to be eligible to apply for settlement in 10 years. If you are later able to meet requirements and make an appropriate application, it is open to you to switch to start a 5 year route, however time spent on the 10 year route will not be counted towards it.

The letter is wrong as you are not applying under Appendix FM. It is likely an error if you completed the correct PBS dependent form.

Are you sure you completed the correct form and did not complete VAF4A??

Where can I find the the application form number?

I have filled the application online in visa4uk.fco.gov.uk by selecting Work -> Tier 2 General -> General Partner - Upto 3 years and Tier 2 General -> General Child - Upto 3 years.

The visa is issued correctly for the duration of my current visa. It's only the UKVI letter came along with passport is mentioning this paragraph. Earlier when I received visa 6 months back, there was no mention about settlement route in UKVI letter.

If the visa has been issued, what exactly does the visa say as 'visa type'?

Visa Type mentioned in passport is "TIER 2 PARTNER" and "TIER 2 CHILD". What is the settlement route/ period for these types as per current regulation?

PBS Dependents require 5 year residence from date of entry before they can apply for ILR.

The paragraph in the letter is not relevant to your dependents as they have not made an application under Appendix FM.
