Applying ILR Only for Dependents - For Self Employed / Contractor Spouse

Post by diliprajan » Wed Oct 25, 2017 1:01 am

People,

I have my Indefinite Lead to Remain in UK thru' Tier 1 General Route which was secured couple of years ago thru' my permanent employment. Due course my job situation had changed and I'm currently self employed / contractor for last 12 months. Now planning to apply for my spouse and kid, they are currently in PBS Dependent Tier 1 General visa And have become eligible thru' 5 years route.

Could you please advise assistance on situation whether my approach looks reasonable for their application?

Set - O or Set M

I'll have to use Set - O application form for my Dependents Visa Processing
Even if I use Set - O only for dependents, I'll need to fill my spouse details as Main Applicant
Or
Use Set - M form because I gone for one more extension on their Visa under PBS Dependent - After securing my Indefinite Leave to remain in UK

Set - O Details on Section 5 - Home and Finance Income

Being a Self-employed / Director for last 12 months. I'll need to provide PaySlips, Divident Vouchers and Letter from my Account to show myself and my spouse can sustain a combined income of 18,600+ GBP as mentioned in https://www.gov.uk/uk-family-visa/proof-income and 3800 £ for 1st Child and 2400 £ for each child after first child

Set - O Complete Section 9a - Tier 1 (General) migrants

Calculate Previous earnings assessment to score points thru a combination or only the latter of the following

Payslips & Dividend Vouchers and/or
Letter from the accountant about the amount to claim as net profit to which I'm entitled

Appreciate your help xx

Dilip

If your partner hold a PBS dependent visa, they can only use SET(O) form. Spouse is the main applicant.

There is no income/financial requirement for PBS dependents applying for ILR. The figures you quote are for SET(M) and NOT for SET(O). You simply need to complete the form truthfully.

This doesn't apply to PBS dependents.
