Tier 2 General from Tier 2 dependent

Hello all,

I am on Tier 2 dependent visa now. my current employer agreed to sponsor me.

My queries are,
1. I have been working for them more than a year as a Java Developer/.Net (Software Engineer/Developer). my salary range is £28,500. I understand that minimum pay scale is 30k to sponsor someone which I will be paid from next year Jan. I fall under SOC code of 2136 as per my understanding. but under this code minimum of 32k as an experienced. so how does the company do this?
2. Can they change the job title to related jobs matches according to the 30k? to ( Software Tester/ )?
3. I know I am pre-selected to the company, can I just continue working for them while they carry out RLMT or terminate from the job?
4. Is there any other issues can be caused by this process as they agreed to sponsor me?

Could you please clarify on these as I would come know where I will be standing during this process.

please advise if anyone been through this process, It would be very helpful.

It is £30k or what the SOC is, whichever is HIGHER.

You will need £32,000pa on the SOC code.

I would strongly suggest your employer NOT manipulate anything to suit you.

sorry I did not get the first statement which you mentioned above "It is £30k or what the SOC is, whichever is HIGHER" could you please clarify me clearly again?

My employer only push to 30k pa, so Is it possible to get the sponsorship for a developer with 30k, rather than changing job title? because my job title fall under 2136 code which needs to be paid of 32k pa as per my research.

My another question was, During the process will they need to terminate me either can continued?

The minimum salary required is £30k. If the SOC states £32k as a minimum, then that is higher than £30k and that is what you must get paid, the HIGHER of the two (£30k/£32k). You must get paid at the rate of the SOC.

another question is how ads should be posted for RLMT. They must know about all these but wanted to double check.

No need to resign but your sponsor CANNOT make the RLMT so difficult and favouring only you that it excludes all other applicants.

Your sponsor should know what the requirements are for RLMT and where the ad has to be advertised. It is all clearly defined in the sponsor guidance notes.

But what would be the solution for me? as already working for them as well as they have agreed to sponsor?

what are the solutions, please could you give me an advise so I can ask and convince them?

Basically, I wrongly said that to convince them. I just double checking that whether possible or not for the role as they can not find people for months. ( They found me over the Social media) by an agent.

- The reason I asked was, I have been offered the job in a different XXX company but they do not sponsor.
so I told my employer that I have got an offer and they demanded me as well. so I have put on my file for sponsorship. they agreed too.
As they are a big firm they must know about all the rules and policies, For me I wanted to know whether this is possible or not, Simple! if they are not possible, I could jump to another company with High pay and something exciting role, why should I wait.

They said that they will do RLMT process and all that, I wanted to double check that whether am on right track or not.

My Question was, Is it possible to run the RLMT or not as hard to fill this job and hardly find people for the role I work on.

your advice, please? as still am not getting a clear pic of that.
