FLR(M) after 33 months on spouse visa in UK

Hi

I been illlegal in United Kingdom since 2003 to 2013 ,been detained in detention for 8 month come out in 2014 ,got married in 2015 British wife and went to India same year and my spouse visa granted in 32 days for 33 month nov 2015 .

The letter I received with visa file says after I complete my this 33month spouse visa you can apply for permanent residency,do I really need extension or shall I go ahead as mentioned in letter,next year 2018 July iam finishing my 33 month spouse visa.

No you cannot apply for ILR (PR). You need 5 years residence on a spouse visa counted from the date you entered the UK before you can apply for ILR.

You will need to extend your spouse visa in form FLR(M) for another 2.5 years first.

There is an error in the letter. This was relevant for spouse settlement visa applications submitted prior to 9th July 2012.

You will have to extend your current visa with a 2.5 year FLR(M) application. You need to complete 5 years of residence in the UK before qualifying for ILR.

A2 level English from a UKVI approved test provider is required for your next FLR(M) application.
(Casa, not CR001)
