Time limit applied on Master and visa gap between the course starts

Post by kedarkhadka » Mon Oct 30, 2017 1:00 pm

Dear all good afternoon,
I am new to this forum and looking an advice from all of gurus and experts. I will try to explain my situation as much as i can.
I have just finished my master (Msc Advanced Biomedical Science) after 3 yrs Bachelor (BSc Applied Biomedical Science). Now i wanted to do another related MSC from Jan 2018, which is 18 month course. But the college has denied to give CAS because this is going to exceed the time limit to be spent on degree level.
I already spent 4 yr 5 month during this visas and i was told that maximum stay is upto 5yr 11 month only because i have done 3 yr bachelor. Although i couldn't get 18 month study CAS letter on january , college has offerd me similar subject (12 month) duration which will start from september 2018. Which is still falls under time limit and i was told that i am elligible for that. But my problem is , visa expires 1st of january 2018 and course will start from september 2018 only. I will be with no visa for about 8 month period. I am really wanting to do this course but doesn't want to go back home country and apply again. Please please suggest me the best ways so i can stay in Uk legally during this period.

Here i have written my staying times during degree level.
BSc : 07/09/13 to 27/09/16 = 3 yr 21 days
MSc: 06/09/16 to 08/01/18 = 1 yr 4 month 3 days
Time already spent = 4 yr 5 month.
Proposed MSc : 03/01/18 to 21/06/19 + 4 month = 1 yr 10 month.
Hence , 4 month going to be over the time limit, i wasn't given CAS.

Some of friend suggested me to apply FLR on January while waiting for the course to start on september. I really need advice on this situation because i really don't have that much money to spend on solicitors and for useless ideas.
Also i dont want to loose the chance of getting PR on 2019 sept, when this will be 10 yrs time spent in UK. I came in UK 0n 2009 sept as a student, studied 2 yr hnd and 2 yr PSW. Also i have a child born in uk (2012 march), who is 5 yr 6 month old now.
I hope my situation has been cleared to you and no been annoyed.
Your suggestions are heartly welcomed.
Many thanks in advance.
Kedar.

This is really too complex to reasonably expect detailed one-to-one advice here. Given that there is a future ILR application and a child in the mix, not just Tier 4, I advise consulting a professional.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

In addition to sah10406 advice, an FLR application is unlikely to drag on for months. HO is very wise to the ruse of submitting applications (frivolous and vexatious) to 'buy time' for either another application you qualify for or to reach ILR. These applications are usually refused in a short period.

hi, Sah, thank you very much for a quick response. Your suggestion highly appreciated. i woould like to explain you more things. I have another CAS offer from another university for related course starting from Feb 2018 but that is also for 12 months. By calculating the CAS duration plus home offices extra 4 month visa , i presume my next visa will finish on May 2019. And again there will be 4 month having no visa before applying ILR on sept 2019. I am very sophisticated now please advise me. I heard that if i apply FLR before applying ILR there is high chance of getting refused and probably deported.
Another case which is on my mind is, may be i will apply for 12 month visa on Feb 2018 for my new masters and on March 2019 when my child will becomes 7yr old and i will apply his DLR making myself a parent of child born in uk.
Please reply me as i become confused what to do next>
Many thanks KEdar
