Naturalisation - Spouse (over 450 days away with medical letter)

Hi,

I am currently on ILR since last 12 months through Tier 2 General 5yrs, now ready to go for Naturalisation.

My Wife has got ILR at the same time when I got mine albeit she was away from UK for over 15 months, that was with a medical letter from India and evidence from NHS showing that was due to medical issues.

Now, including that 15 months & 8 days, she is also away this Year for 7 Weeks, that will make her time away from UK to just over 17 months (510 days). By using same medical evidence support documents, will UKVI grant naturalisation for her OR should I wait for 3 years from the date that I get my Naturalisation done and then apply her's as a spouse of British citizen please?

I would be grateful if you could let me benefit from your knowledge/expertise.

What year or what are the exact dates of her absence?

You are misunderstanding the 3 year BC spouse issue. Nowhere does it state she must have been married to a BC for the whole 3 years. You only need to be BC at the time of her application.

You would be asking for discretion and HO do not have to use discretion. If you take a chance and apply and it is refused, you lose the fee. There are no appeal rights for citizenship applications either.

Hi CR001,

Many thanks for the response, much appreciate it.

She initially joined me in the UK 10/05/2012, then left UK 01/08/2014, got back to UK 08/11/2015, got ILR 28/10/2016 and away from UK again between 29/06/2017 and 20/08/2017.

To play safe, I will stick with what you said earlier.

What is naturalisation process timescale please? UKVI taking full 6 months or processing in well less than 6 months?

Timescales vary, sometimes a couple of months, sometimes 6 months or longer.
