FLR-M query

Post by Test4u » Sat Nov 04, 2017 7:20 pm

Hi Friends

I have read posts on flrm but couldnt find the answer yet.
I believe its an easy one for you guys

1.current spouse visa(spouse of british citizen)expiring on 11 dec 2017 aftr 2.5 yrs
2. Is it ok to apply on 17 nov postal?
3. If visa granted date is before 11th dec (say 05 dec) then there ll be a gap of 6 days before completion of 5 years(I.e. visa ll be til 06th june 2019 and for 5 years it shd have been 11th june 2019for ilr ) ,
can spouse still apply for ilr without extension 28 days before 11june2019?

I appreciate your support

Thanks

2. Yes

3. Unlikely you will get a decision so soon applying by post. It take a few weeks.

The spouse can apply for ILR within 28 days before reaching 5 years, calculated from the date of first ENTRY to the UK on a spouse visa.

What if apply in person on 5 dec say then there will be a gap of few days. In this case, still 28 days before 11 jun2019 spouse can apply for ilr? Note spouse will only have visa till 05jun not till 11 june 2019.

The spouse requires a valid visa at the time of ILR. It does not state the visa must be valid till the 5 year mark or after.
