Dependent ILR Clarification - qualifying period.

Dear Members

My wife is eligible for ILR as of November 13th 2017. i am planning to go to Premium services .
Appointment was only available from December 6th 2017.Her visa expires only on March 2018.

Q:-
We were outside UK from December 6th 2016 to Jan 12th 2017 - Vacation. Could someone please confirm if this is an issue or should we apply after Jan 13th 2018 .

Appreciate your advise in this matter.

Sorry ,I did not understand the question.

She came to UK as Tier 1 Dependent on 12 -Nov - 2012 and she is eligible for ILR on 12/13-Nov-2017.
I thought I could get an premium service appointment before December 6th.But the appointments are available only on Dec6th onwards when I checked.

Do you see any concerns .

You can apply at any time even after reaching 5 years. The 'apply within 28 days' etc does not mean you lose the right to apply if you don't apply by the 5th anniversary.

Thank you for the replies ,the only concern I had was about her not being in UK same time last year when we apply for the ILR on December 6th 2017.

I hope that should not be a problem from what I understand.

There is no requirement to have been in the UK on the same date a year ago.

You are confusing this physically present requirement with Citizenship.
