ILR for tier 2 general dependant

Post by UKWorker007 » Sat Nov 11, 2017 9:16 pm

My wife is on tier 2 general dependant visa. She came in UK in June 2013 and would be eligible for ILR June next year 2018. She is working and currently on maternity leave and she has gone to India for 4 months (sept-dec 2017) approx 120-130 days.

1. May I know how many days she can stay out of UK so as to NOT break continuous residence rule required for ILR. Is it 90 days or 180 days absence allowed in a year for tier2 general dependant?

2. Also, May I know if she is out of UK on UNPAID maternity leave, Will there be any issue in getting ILR with unpaid absence? Are only those absences allowed which are taken on paid leave? (she is working women although she is tier2 dependent)

3.I have read that for each absence we must state the reason. What evidence would be required in this case
and Would the reason here valid/ be considered?

Thanks.

1. There is NO absence limit for PBS dependents.

2. There is NO mandatory requirement for PBS dependents to work and earn money or any issue regarding unpaid leave.

3. Maternity??? There is NO requirement for PBS dependents to submit evidence or reasons for absence.

You seem to be confusing the requirements of main Tier 2 General visa holders with PBS Dependent visa holders. They are not the same.
