Eea2 to RC of a family member of a British, after brexit?

Post by driftkid » Fri Nov 17, 2017 7:59 pm

Hello guys, I am again asking some help and advices regarding my family's Resident card. On December 12, 2017, my wife and 2 girls, philippine Citizen will be 5 years residents here in UK, they have eea2 residence card valid for 5 years, I am a british national, worked in Italy before coming in UK. I'm planning to apply thier PRC after December 12, assuming that it will be 6 months processing time, so they will get the PRC sometime on June 2018. Eventually I need to wait 1 year before my wife can apply for British Naturalisation, it will be June 2019. The problem is UK will leave EU on March 29, 2019. As family members of a British National, what are thier options?

You are mistaken. As the spouse of a British citizen, there is no requirement to wait 12 months to apply for British citizen. As soon as she gets her PR document, she is able to apply. Your children too.

Are you British born? If so, your daughters would be British by Descent.

Thank you cr007, I was born in the Philippines and got my citizenship by descent, do my kid's need PRC before they can apply for Naturalisation? So after my wife gets her PRC she can apply for Naturalisation? Wow thanks for the good news! I'm so relieved.

You would still need to register your children. You can look at registering them under Section 3(1) once they have PR or you could look at registering them under Section 3(2) or 3(5), depending on your circumstances.

See page 10 onwards on the difference in requirements for 3(2) and 3(5) applications in terms of your UK residence.

https://www.gov.uk/government/uploads/s ... y_2017.pdf

They would not require PR for either of these two and can apply at any point they qualify but they would require PR for the Section 3(1) application.
