Tier 2 ICT visa - have a new job with salary > £73900

Hi,

I am working in the UK on a Tier 2 ICT short term staff visa , I have a new job with an employer in the UK with a salary of more than £73900. If I go back to home country , can I come back immediately on a long term ICT visa or would cooling off period apply ? Has anyone faced this situation and how did you workaround it?

You cannot apply for ICT if you do not work for the employer in your home country.

Do you mean 'Tier 2 General visa'??

See page 21 in link below. You will be subject to the cooling off period unless you have a salary of £159,600pa or higher.

The OP seems to be suggesting the ICT visa which requires no prior experience with the sponsor

Long-term Staff
This visa is for transfers of more than 12 months into a role that can’t be filled by a new UK recruit.

You’ll need to have worked for your company for more than 12 months, unless they’re going to pay you £73,900 or more a year to work in the UK.


Unfortunately this does not seem to waive you of the 12 months cool-off period as you want to move to a new employer
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

But presumably one would still need to work for the employer abroad who is linked to the UK employer by the intra-company link, albeit not necessarily for full 12 months. So would you be working for the overseas linked employer when you go back home? If not, then ICT is not an option.

My understanding of the rules is that the cooling off period for ICT would only be waived on a salary of £120,000 or above.
