This is Adnan. on 2nd February 2017 I have made a fresh application to leave to remain under family /private life 10 year route and human rights claim in person at Festival court, Glasgow under . The case worker took an interview regarding concerning TOEIC. however, The case worker couldn't reach to a decision on that day I was promised a decision will be serve within a week or max a month.
The decision was hold from 22nd of February after a judgment of the supreme court in MM( lebanon & others v SSHD(2017) UKSC10.
Dated on 14/11/2017 I have a received a decision by royal mail (signed & tracked ) on 17/11/2017 my application was refused because of TOEIC.
Personal history: I am married and with three children ( my eldest child (10 yrs) just got passed 11 plus exam going to enroll local Grammar school in 2018. Other two children are 4 and 2 they all are British citizen and my wife has ILR and we already made an application to be naturalized ,hopefully she will be British citizen with in five weeks from now.
Immigration history:
entered in UK October 2004 as a student,leave valid until 21 October 2005.
28 October 2005 applied as a student and leave was granted from 29th of November until 28th of February 2009.
27th of February 2009 as a student ,leave granted from 03 march 2009 until 31st of may 2012.
28th of may 2012 Tier 4 (general ) leave was granted 13th of September 2012 until 30th of March 2014.
27 March 2014 Tier4 (general ),leave was refused on 7 may 2014.
03 June 2014 for leave to remain on the basis of 10 year family /private life , leave was refused on 09 January 2015.
HO served as overstayer on 21st of October 2016. ( in that case did I not completed 10 years lawfully ?
The only truth is and nothing but truth and the whole truth is I did not committed any wrong doing regarding TOEIC. I sat the test on my own and I passed the test with my own ability and I am sure you would agree with me passing a TOEIC is not a rocket science !!
I have only another 10 day from now and I was given right to appeal. I am not allowed to work therefore won't be able to hire a good barrister.
what should I do ? can't really think any positive ancillary. and not to mention cynical sequel in our family life.
any positive advice will be highly appreciated !!
