Query regarding ICT Tier 2 Long Term/Short Term Staff Migrant Visa

Hi All,

I have a query regarding Visa policy of UK.

Query –

Currently, I am in ICT Tier 2 Long Term Staff Migrant visa type and which is expiring on June 26, 2018. My spouse is in UK on ICT visa but not on my dependent visa. She is also on ICT Tier 2 Long Term Staff Migrant Visa type.

Is it possible for me to apply for a dependent visa on her ICT post my visa expiry(after 26 June 2018) or I have to serve a minimum cooling period of 12 months to apply again for an ICT or Dependent ICT.

Could you please let me know your response on this, so that I have to take decision accordingly.

There is NO cooling off period if you are switching from ICT to ICT dependent. You MUST switch BEFORE your visa expires if you want to apply within the UK.

Another small query, if I am on dependent and want to change it to ICT, then I agree that I have to travel back to country of nationality, but whether there will be a cooling off period to raise ICT long term from dependent visa.

Do you mean 'Tier 2 General'??? Yes then you will be subject to the cooling off period but you can remain in the UK as a PBS Dependent for 12 months to meet the requirement and then apply from home country.

No, not Tier 2 General.

Will convert from ICT Dependent Visa to ICT Tier 2 Long Term Visa, will there be a cooling off period?

Why would you not want to apply for Tier 2 General, which does lead to ILR after 5 years?

You can only apply for ICT if the following applies. If you are not being offered the required salary, you must have worked for your sponsor in your HOME COUNTRY for 12 months before you qualify for ICT.
Types of Intra-company Transfer visa
There are 3 types of Intra-company Transfer visa.

Long-term Staff
This visa is for transfers of more than 12 months into a role that can’t be filled by a new UK recruit.

You’ll need to have worked for your company for more than 12 months, unless they’re going to pay you £73,900 or more a year to work in the UK.
Will convert from ICT Dependent Visa to ICT Tier 2 Long Term Visa, will there be a cooling off period?
To qualify for a Tier 2 main visa again, you must be on a PBS Dependent visa for a full 12 months IF you have held your own Tier 2 visa before switching to PBS Dependent.
