Wait for Appeal date or Apply again?

Hi
I'm British and I got married to my Vietnamese wife last year, she visited uk at Christmas 2016 and we have been together 4 years and I have spent allot of time in Vietnam.
We applied for a spouse visa in February 17 as we want to live together in uk (it does not seem unreasonable to me), the requirements from her side were accepted but it was rejected due to my finances, So we have made an appeal... I'm an engineer and work through a limited company I easily meet the 18k requirement but some things they wanted to see were missing about the company. We had 28 days to submit info that was missing, my accountant put together the required company documents ( I should have used him at the beginning )

Finally last week we got a note to say the appeal date will be February 18! At this point i'm thinking we should be using a lawyer to help with this appeal. I'm sure we meet all the requirements so I phoned a lawyer last week. He told me not to bother with the appeal and make a new application, as the new info I sent within 28 days will not even be looked at and that the appeal was just to prove they made the wrong decision based on what i send in to start with? So why give me a chance to send in the few documents they listed that were missing ?

OK so what am I asking... in this situation is the appeal worth waiting for and if so how should I prepare for it or should we just write of the original application and start again ?

One cannot contribut without knowing the full fact's.

There are circumstances where the Home Office are required in law to contact you if certain evidence are missing.

The recent supreme Court indicates an appeal may succeed even if new evidence are provided post decision.

Thanks Obie I guess we shall keep on waiting, if there are any recommendations of anyone that look at our case a little closer that would be great as we have clearly not done so well on our own.

Hi my wife was refused a visa this year due to financial requirements, I am going to the Tribunal in February so to try and show them that they I do meet there requirement.

I'v asked this before and really need some help with this. Can anyone recommend a lawyer or adviser to go through this with me and if we need to make a fresh application to make sure its all done correctly.
