Tier-2 ICT to Tier-2 General

Hi,

I was in UK on Tier-2 ICT long term VISA and i returned back in India on 20th May 2017. Now I have job opportunity in UK on Tier-2 General VISA, however due to cooling off period my Tier-2 General VISA cannot be processed because of 12th cooling period.

I read all the cause of this rule and exceptions , there is one clause which says 'The applicant was only in the UK as a Tier 2 migrant during the last 12 months for a short period or periods with a CoS which was assigned for 3 months or less.' With reference to this rule, I went in UK on Tier-2 ICT Visa on 6th March-2017 and returned left UK on 20th May 2017 and this Visit I stayed there only for 11 weeks which is less than 3 months and I never went again, however I was on ICT long term VISA at that time which has two years of Validity and now I am getting Tier-2 sponsorship from new employer, Could someone please know me urgently that I still need to serve cooling off period of 12 months in this situation?

12 month cooling off applies to you. Your ICT CoS was for more than 3 months, as the clause states.

Hi,

I have a job offer from UK employer on Tier-2 general VISA, Could someone please let me tell me if I need to appear for the IELTS exam and do I need to also prove that my degree has been completed in English through the NARIC process. I am bit confused on this because I am not getting proper answer from my sources available. It is permanent job offer. I also know that Tier-2 VISA sponcer should do all this but this both will take more than a Month and I cannot wait for this.

What exactly is your sponsor suppose to do?

The English requirement is YOUR responsibility not your sponsors.
