T2 Partner ILR - Help needed!

Dear Forum experts,

I was looking to get some clarifications around my wife’s ILR application. I thank you all in the anticipation that you could guide me in the right direction.

My wife is currently on T2 Dependant visa and would be completing 5 years on this category in January 2018 and would be applying for ILR soon. She is applying separately as I got my ILR approved in Oct 2017.

She is not currently employed and is a stay-at-home parent. She was in Full time job but since March 2017, she left her job following the end of her maternity leave. I was wondering if we have to satisfy any income criteria or any maintenance funds. Few other questions I have are as below:

1) Am I correct in assuming that we have to use the same T2 ILR SET (O) form? If So, will she fill the form as a Main Applicant?

2) What details do we have to provide under section 5 – “Your Income” section? Specifically to question 5.4 Does a relative or friend of you or your partner, or both of you, regularly give you money? And 5.6 with regards to SOC code etc?

3) As she is not into any employment at present – do we have to show the maintenance funds?

4) Does she require to satisfy the English level qualification – she didn’t have to appear for any English qualification earlier as a part of T2 Dependant visa?

5) Document wise – we are providing marriage certificate, Joint utility bills, Joint Mortgage statement, Joint bank account statement, her bank statements, her passport and T2 BRP, my passport & ILR BRP copy and Life in the UK test? Any other documents we need to provide?

6) Part 12D of the SET O) form requires a Letter from Sponsor - do we have to provide any letter from my employer to satisfy the criteria that I am still working for the same company post my ILR etc?

It is all so confusing and your help will be highly appreciated.

Have you calculated her residence based on her date of ENTRY to the UK as PBS Dependent?

No.

Set(O) form yes. She is the applying and therefore the main applicant.
2) What details do we have to provide under section 5 – “Your Income” section? Specifically to question 5.4 Does a relative or friend of you or your partner, or both of you, regularly give you money? And 5.6 with regards to SOC code etc?
Complete the form honestly regarding 'Your income' and state yours only if this is the current situation. 5.6 is not relevant as she is NOT a Tier 2 General visa holder but a PBS Dependent visa holder.

No maintenance funds for ILR.
4) Does she require to satisfy the English level qualification – she didn’t have to appear for any English qualification earlier as a part of T2 Dependant visa?
Yes, she needs to meet the English B1 requirement and Life in the UK.
5) Document wise – we are providing marriage certificate, Joint utility bills, Joint Mortgage statement, Joint bank account statement, her bank statements, her passport and T2 BRP, my passport & ILR BRP copy and Life in the UK test? Any other documents we need to provide?
Assuming you mean 'her LIUK test' and not yours.
6) Part 12D of the SET O) form requires a Letter from Sponsor - do we have to provide any letter from my employer to satisfy the criteria that I am still working for the same company post my ILR etc?
Not relevant to PBS Dependents.

Thank you Char (CR001) for your help as always. Could you please further clarify section 5 - Finances based on my comments below.

Yes, I calculated her eligibility from the date she first entered the UK.

With regards to section 5 - as we have a joint mortgage and obviously I pay for the mortgage, I assume we need to select owned by you in question 5.1 and for 5.2 Do you or your partner, or both, pay
any rent or mortgage for your home? - we select Yes. I will also be providing a support letter whereby I'll explain the finacial and work situation.

She does not get any regular income from anywhere as I cover all & every expense for my family - so we select NO for question 5.4

She is soon appearing for English Level Qualification and Life in the UK Test.

Correct yes. No need for a letter as there is no requirement for your dependent to work.
She does not get any regular income from anywhere as I cover all & every expense for my family - so we select NO for question 5.4
Should be fine.
She is soon appearing for English Level Qualification and Life in the UK Test.
Make sure the English test centre is on the HO approved list (it changes frequently).

Hope you had a good Christmas and looking forward for the new year!

I was booking my wife's premium appointment and was confused which option to select - Do I need to select Tier 2 Migrant or Dependant within the visa category?

Her current BRP mentions PBS Dependant as VISA Type but when she first received her sticker visa from India in 2013 the type was mentioned as Tier 2 Partner so, selecting T2 or Dependant from the category list for premium appointment is confusing me.
