180 days rule for TIER 2 GNRL Dependant

Post by sri0306 » Sun Nov 26, 2017 9:13 am

Hello All,

I am currently living / working in the UK on a TIER-2 General Visa. My pregnant wife went to India in Sep this year. She is planning to be in India for more than 6 months. Could someone please let me know if it is ok? or will it be considered as a more than 180 days break as per the ILR continuity rule while applying for her iLR?
I have gone thorough the gov.uk website, looked at most of the rules. however, I cannot find any specific rules for dependants.

Your help is highly appreciated.

Regards,
Srinivas.

The 180 day absence rule doesn't apply to PBS Dependants.

Thank you so much for your prompt reply Casa. Shall I wait for some one who had a similar case and successfully received an ILR to reply?

Regards,
Srinivas

You can by all means, but I can assure you there is no 180 absence limit for a PBS Dependent.

The requirement was withdrawn in an amendment to the Immigration Rules on 16 March 2017.

To confirm what Casa has already advised twice now, there is NO absence limit for PBS Dependents.
