advice on husbands visa refusal.

Hi i was wondering what to do. applied for spousal visa for my husbands and he jusr received a refusal letter. their reason for refusing was that he did not submit a tuberculosis certificate. we however submitted this evidence and have proof that we did so. i think UKBA did not bother looking at the various evidences well before making their decision( they currently still have all our originals including said certificate). my question now is what is my next step because i refuse to pay to appeal for a mistake they made.

Unfortunately you will need to pay an appeal or reapply for another visa. It is most frustrating, but that is the Options you have.

Send a Pre Action protocol, but they may come back and say you have a right of appeal.

re applying is a no right now because we just don't have the money after spending thousands including lawyer fees and nhs charges. i will have to get in contact with my local MP and appeal aswell. its just not fair when they messed up and we have to pay for it. playing with peoples lives.

Was the TB certificate valid and in date (not expired)?
Char (CR001 not Casa)

Start a small claims civil action to recover the money? Anyone care to comment on success of this in the past? I know it's may not be that quick but might focus UKVI minds on getting a correct decision.
