ILR with Ancestry Visa & Baby

Post by Nelson2562 » Wed Nov 29, 2017 8:57 pm

Hi all

Myself and my husband have lived in the UK since 2011, firstly on a Tier 5 then on my ancestry visa, with him as spouse. We had a child this year and I am no longer working having been made redundant half way through my pregnancy. We own a property here and had intended to settle permanently. We are due to apply for ILR early next year and stupidly I did not think to check that being employed is actually part of my visa requirement. Surely this must be a relatively common occurrence however I can't see anywhere on the SET(O) for where this exploitation could be laid out...

Also if I am able to make the application how quickly has the turnaround been lately using the regular non-premium service?

Thanks

Maternity leave is acceptable, so don't stress too much.

Postal applications take anywhere between a couple of months to 6 months or so.

I thought so, except im not on maternity leave, i was made redundant and was not going to look for work again until my son is a year old. Would that be acceptable?

No, I was made redundant in October 2016 and I don't think I am entitled to SMP

When will you go back to work?

When does your visa expire?

Even working part time would be acceptable by the way but yes, Ancestry visa is an employment visa.

Maternity Allowance is not considered a benefit or public fund for immigration purposes. You are/were entitled to claim.

I intended to go back to work once my son was about a year old, around May 2018. Our visa expires on March 15.
