Indefinite visa for my wife

Indefinite visa for my wife

Hi All

let me start with some back ground.

My wife came in UK in Jan 2010 on student visa. then she went back home in 15 March 2013 (her was expiring in 31 May 2013). We got married in March 2013.

- she applied as my dependent (i was on PSW visa that time). and get new entry clearance on 10 July 2013.
- then i switched my visa in Feb 2014 to Tier 2 work permit and she switch to PBS dependent.
- again in 2016 i changed my employer and got new Tier 2 ( my wife PBS dependent) which was suppose to expire in June 2018.
- in Feb 2017 i got my ILR based on 10 years. but i didn't applied for my wife visa yet.
- she is still on PBS dependent visa. which is expiring June 2018.

Now my question is

1) is her stay legal till June 2018? or she has to change her visa to FLR(M). if its legal can she travel outside UK?
2)can she apply her indefinite visa in June 2018. as it will be 5 years as on dependent visa?
( if i switch her visa to FLRM now she has to complete 5 years again on this category)

1. She should switch to FLR(M) if she has travel plans out of the UK.

2. No she cannot. Her clock will reset to zero when she switches to FLR(M) for ILR based on 5 years residence. She will only qualify for ILR after 5 years on FLR(M) or 10 years long residence in January 2020 if she meets all the requirements.

What English test she should require for FLR(M).
so i'll ask her to put FLR(M) now and then apply for indefinite in 2020 Jan (10 year )
