Switch visa from Tier 2 ICT to Tier 2 General Dependent

Post by nmk17 » Thu Nov 30, 2017 9:34 pm

Hi Experts,

I am currently in UK on Tier 2 ICT visa and my wife came along with me as a dependent in Sep'15. Now my wife has got a sponsor and her visa type has been changed to Tier 2 General Long Term in Aug'17.
Now I want to switch my visa type to Tier 2 General Dependant keeping my wife as main applicant in Jan'18.

In this scenario, please guide me with below questions:
1. Do I need to go back to India to change my visa type?
2. If I need to go back, Does my wife require to travel with me?
3. What documents I need for the visa as my wife's employer is not sponsoring the dependant visa.

Thanks in advance.

1. No you don't. You can apply to switch within the UK.

2. Not relevant.

3. Read the PBS Dependent guidance notes. You are dependent on your SPOUSE for Tier 2 dependent NOT on her employer.

Thanks for the reply. That was very helpful.

I have many people telling me that I will have to go back to India to apply for dependent visa as I need entry clearance from there.

Is that true?

Is that needed when I'm already in the UK on a different Visa?

Regards

No it is not true. Stop listening to 'many people' talking nonsense. You can apply to switch to PBS Dependent visa WITHIN the UK once your spouse has Tier 2 General and has returned to the UK.
