Tier2 General - ILR - Continuous period

Hi,

I am applying for ILR and have following queries. Did anyone face the similar situation? Please advise.

1. I came to UK in Oct, 2012 and my wife came to UK in June, 2013. Are we both eligible to apply for ILR in the month of March, 2018? Both of our Visas stamped in Sep. 2012 and visas are expiring in March 2018.

2. While calculating continuous period, from the example shown in documentation (back calculated from the date of application), if we apply in MArch 2018, can my wife claim 5 year continuous residence in UK eventhough she is short of 2 months?

1. No you are not. Your wife's 5 year residence clock starts counting from the date she ENTERED the UK and not the date of visa stamp.

2. No, she cannot. The 'calculating continuous residence' document section you are referring to is applicable to PBS Main visa holders and not dependents.
