Hi
I wanted to get some help
I came to uk on student visa September 2012 and was applied for extension on tier 4 inside uk got that aswell successfully and then I got married in December 2015 and applied for spouse visa inside uk in April 2016 and got it successfully under 5 year route and now I applied for the extension and got an reply saying the I do not qualify for the 5 year route so they put me on 10 year route and issued me with visa so I wanted to ask for indefinite ILR can I use my count my previous visa or do I start the counting of visa from now as I have been put on the 10 year route as if my previous visa counts then I only have to apply once more time for leave to remain and then ILR so please let me know any helps please as it very long to wait 10 year

If you asking about 10 years long residence route yielding ILR then yes all previous visas if relevant conditions kept on meeting are countable. But not sure whether it will still remain until 2022 when you complete 10 years.

Thanks seagul for the reply really appreciate that
But I wanted to ask as you have written that you are not sure what will remain when my ten years complete the route leading to ILR remains or something else as I have been told by the Solicitor that I will have to reapply the same visa again one more time when it expires then apply Under SETLR which is indefinite leave to remain I think.

And yes that’s what the solicitor saying aswell the 10 year long residence so when for example my current leave to remain expired in 2020 and then I will apply another 2.5 year of leave to remain And that should expire in 2022 or beginig of 2023 so after that I can apply for 10 years long residence ILR as I will be living more then 10 years living in the uk lawfully by the time I apply which will be 2023 but you said that you not sure what is that you not sure of that’s what I’m asking

My mean is that year 2022 is too far so right now we can't predict whether that route will remain active or not. But if it remains active then you should be able to apply ILR on 10 years basis as long as you kept on fulfilling the conditions & requirements of relevant visas.

I wanted to ask if I wanted to switch back to 5 year route if I in future meet the requirement can I do that and if I can will my old 2.5 visa will count towards ILR and my 2.5 visa was in 5 year route and just recently when I applied for extension they gave me 2.5 visa but on 10 year route as I was not meeting the finincial requirement and also I came to uk on student visa in 2012 so which will be better to stay on the current 10year route as I can apply for ILR in long residence route in 2023 as by that I will complete 10 year in uk without any break of visa rules please kindly help thanks
