You can apply within 28 days before reaching 5 years residence.

Thanks a lot. One last question once I apply settlement how long should I have to wait to apply citizenship?

If your spouse is British, you can apply for citizenship once your ILR is granted and you have your BRP card, provided you meet all the requirements of spouse of BC citizenship based on 3 years residence.

Do you mean based on 5 years of residence instead of 3? I was sort of confuse

There are two sections of the British Nationality Act under which a person can apply.

Section 6(1) is based on 5 years residence, qualifying with 5 years residence (6 years really which includes 5 years residence and 1 year on ILR).

Section 6(2) is based on being married to a British citizen and is based on 3 years residence but you must have ILR. You DO NOT have to wait the 12 months on ILR to apply as spouse of British citizen.

Hi,
About the supporting documents do I have to send correspondence that cover 2 years? Could you pls advice me or that would be helpful if you send me documents checklist please? I have been going through ho website and couldn't find it.

Proof of co-habitation must cover the full 2.4 year qualifying period. 6 pieces of evidence from at least 3 different sources in JOINT NAMES, or 6 pieces EACH if in SINGLE NAMES. A general guidance would be 1 (or 2 if in single names) every 4-5 months.
