Returning British Expat with Non UK spouse and children

Post by DSguy » Wed Dec 06, 2017 3:15 pm

Hi, I'm looking for some advise on returning to the UK .

I am a born in the UK citizen who has lived and worked overseas most recently in the USA. which is the base we are returning to the UK from .

My wife is a national of Guyana and has a 10 year UK visitor Visa as well as a USA L2 visa
My step son (6 years old) is a national of Trinidad and Tobago and does not require a visitor visa for the UK but does require a visa for over a 6 month stay.
Our Son has just been born in the USA and I need to apply of his US and UK passports.

My intention is to just travel back at the end of February and then apply for the Leave to remain for my wife and step son , We are looking at coming home for at least 5 years as I have two other kids in the UK that need their father around for at least that long until they can travel freely on their own .

Any one see any issues coming my way with what I have proposed ?

Do you mean your spouse and step son arriving in the UK as visitors and applying for a spouse visa while in the UK as 'visitors'??

It is NOT permitted to switch from a visitor visa to any other visa category within the UK. There have been many refusals (and removals from the UK).

They should apply for a spouse/child settlement visa BEFORE coming to the UK and you would be required to meet all the requirements.
