When Can I apply for 5 year tier 2 ILR?

Hi All,

Just want to know this for the future - As I was converting my Tier 2 from a Tier 4 visa, I applied in-country and the Tier 2 visa was issued on the 10th Aug 2014. However, I only started work (start date on my COS as well) on the 21st Sept 2014.

As I understand it, we are allowed to apply for the ILR 1 month before the 5 year mark. Question is, do I start counting from the 10th Aug (Start of my Tier 2 visa) or the 21st Sept (1st working day)? Obviously I would like to apply asap so would like to check!

Hi,

You can apply ILR 1 month earlier from Tier 2 Issued date. In your case you can apply after 10th July 2019.

Please don't give out such incorrect advice, which would result in ILR refusal. It is NOT a 'month' in earlier and not 10th July. You can apply for ILR within 28 days before reaching the qualifying period or date of original visa stamp.

Within 28 days before 10th August 2019 yes, as the rules stand now.

You should be able to apply on/from Saturday, 13 July 2019
